What’s the benefit and legal rules to having a Literary agent?

I have just a few questions:
What’s the benefit of having a literary agent to work with you besides the fact that they can find you a publishing house? And is there a specific age you have to be to acquire an agent? I’m not entirely sure what the different is between a query letter and an entire book proposal, it’d be wonderful if someone could explain that…?

For the most part, it is impossible to get published these days without an agent.

An agent serves as a buffer between the writer and publisher. Most writers are crap and have no clue, which is why publishers no longer read “over the transom” (unagented) unsolicited work. They have far better things to do.

An agent is paid a percentage of what an author makes. Therefore, it is in the best interest of an agent to represent only the very best of the very best, those who have created work that is worthy of publication AND sales.

A publisher, especially one that has a relationship with an agent, knows that the agent has separated the wheat from the chaff and will bring only worthy manuscripts for consideration.

It’s all about money.

There is a contract between the agent and writer that requires that the writer be of legal age or that the writer is represented by an adult (parent, guardian).

There are plenty of websites and books that explain the difference between a query letter and a book proposal. Queries are sent for magazine articles, investigative assignments and “do you want to see my pages?” A book proposal is just that. Better that you research the matter so that you know the difference.

A lack of education, lack of experience, lack of information and out and out ignorance are the main stumbling blocks for writers. Publishing is an incredibly difficult, nasty business and anyone who ventures forth needs to know what he/she is doing before taking the first step.
